மே தினம் - வரலாற்று நிகழ்வு

அமெரிக்கத் தொழிலாளர்களின் எட்டு மணி நேர வேலைக்கான போராட்டமும், சிகாகோ போராளிகளின் தியாகமும்தான் இன்றைக்கு மே தினமாக, உழைப்பாளர்களின் தினமாக நம் முன் நிற்கிறது. இப்படியாக, பொதுவுடைமைத் தத்துவத்திற்கு பெரும் எதிர்ப்பு காட்டி வரும் அமெரிக்காவில்தான் உழைப்பாளர்களின் அடிப்படை உரிமை முதன் முதலில் நிலைநாட்டப்பட்டது என்பது வரலாறு காட்டும் பாடம் ஆகும். எங்கு அழுத்தம் அதிகமாகிறதோ அங்கு நிச்சயம் புரட்சி வெடித்துக் கிளம்பும்.

பெற்ற சுதந்திரம் பறி போகிறது !

நேற்று வரை நம் முன்னோர்களின் தியாகத்தால் நாம் பெற்ற இந்த 8 மணி வேலை என்ற சுதந்திரம் , இப்போது ஏகாதிபத்திய அரசுகளால், முதலாளித்துவ சக்திகளால், பன்னாட்டு நிறுவனங்களால், நம்மை அடகு வைக்கும் ஆளும் நாலாந்தர அரசியல் வாதிகளால் படிப்படியாகப் பறிக்கப் படுகிறது. 10 மணி நேரம் , 12 மணி நேரம் நீ வேலை செய்தால் என்ன என்று நம்மிடமே கொடூர எண்ணம் கொண்ட அதிகாரிகளால் இன்று தைரியமாக கேட்கப் படுகிறது . மீண்டும் அடிமைச் சாசனம் எழுதப் படுகிறது.

மீண்டும் புரட்சிக்கு தயாராவீர் !

இதிலிருந்து நாம் மீள வேண்டுமானால் , பெற்ற சுதந்திரம் பறிபோகாமல் காக்கப் படுமானால் என்ன தியாகத்திற்கும் நாம் தயாராக வேண்டும். தொழிற் சங்கம் என்ன செய்தது என்று கேட்பதை விட்டு , நாம் என்ன செய்ய வேண்டும் என்ற உணர்வு ஒவ்வொரு தோழனிடமும் வெடித்துக் கிளம்ப வேண்டும். அதிகார மிரட்டலுக்கு அடி பணியாது , தண்டனை களுக்கு பயந்து ஓடாது , போராட்ட குணம் வளர்க்கப் பட வேண்டும். தொழிலாளர் சக்தி அற்ப எண்ணங்களுக்காக பிரிக்கப்படாமல் , ஒன்று படுத்தப் படவேண்டும். மீண்டும் வரலாற்றுப் போருக்கு இளைஞர்களை நாம் தயார் செய்திட வேண்டும் . இதுவே மே தின தியாகிகளுக்கு நாம் செய்திடும் உண்மையான அஞ்சலி ஆகும்.
மே தின தியாகிகள் நினைவு ஓங்கட்டும் !
புரட்சிக்கான சிந்தனை பெருகட்டும்!

Another Mile Stone Judgment in favour of Pre-2006 Pensioners

20 years’ Service enough for full pension 

even for  Pre-2006 Pensioners

Outcome of Supreme Court Judgment on this issue





Apex Court dismissed SLP No.C…/2014 CC No (s) , 20144/2014 on 20-02-2015. This SLP was arising out of final judgment of Kerala High Court at Ernakulam dated 07.01.2014 in OPCAT No.8/2014 viz., Union of India vs M.O.Inasu.

The Kerala High Court judgment under question was a judgment of Ernakulam Bench of CAT filed by Mr.M.O.Inasu and Mr.K.Ramachandran Unnithan made on re-hearing as directed by the Kerala High Court that ordered to implement the  6th CPC recommendation of reducing the required 33 years of service into 20 years’  for grant of full qualifying pension of 50% of LPD or 10 months average whichever is greater to Pre-2006 Pensioners.

Kerala Comrades have supplied the judgment of CAT Ernakulam Bench viz., OA No.715 of 2012 with OA No.1051 of 2012. The OA No.715 of 2012 pertains to the case filed by Mr.M.O.Inasu  and the OA No.1051 of 2012 pertains to the case filed by Mr. K.Ramachandran Unnithan . Both of them were retired Deputy office Superintendent in Excise Department. The above referred Kerala High Court judgment and the dismissal of SLP by the Apex Court have come as final outcome of both of their OAs in Ernakulam Bench of CAT.

The crux of the judgment of Ernakulam Bench of CAT upheld by Kerala High Court as well as by the Apex Court is as follows:

  1. Both M.O.Inasu and K.Ramachandran Unnithan are Pre-2006 Pensioners. They were Ex-Servicemen and thereafter Deputy Superintendent in Excise Department before retirement. Their combined services were less than 33 years of service and therefore they were granted only pro-rata pension and not full pension @ 50% of 10 months average pay.
  2. Both claimed for full pension @ 50% of their last pay drawn as recommended by the 6th CPC for employees with 20 years of qualifying service instead of 33 years.
  3. Tribunal initially considering as to whether the Pre-2006 Pensioners are eligible for 50% of the minimum pay in the relevant Pay Band plus GP even if they do not have put in 33 years of qualifying service came to the conclusion that they are not entitled to and dismissed the OAs as above.
  4. The Pre-2006 Pensioners appealed in Kerala High Court against the order of the CAT Ernakulam.
  5. Kerala High Court had set aside the order of the CAT Ernakulam Bench vide O.P.(CAT) Nos.898/2013 and 1409/2013 vide judgement dated 04.06.2013 and directed the CAT to re-hear the applications and consider entries at Sl. Nos. 2 and 12 of the Resolution No. 38/37/08-P&PW(A) dated 29.08.2008 of the Ministry of Finance.
  6. The Ernakulam Bench of CAT based on the observation made by the High Court thereafter had pointed out the para 4.2 of the OM dated 01.09.2008, that there is no  stipulation of any minimum period of service for eligibility of  pension @ 50% of the minimum of the pay in the Pay Band  plus Grade Pay of the post from which the pensioner had  retired. According to para 4.2, it is made clear that the pension should in no case shall be lower than 50% of the  minimum of the pay in the Pay Band plus Grade Pay  corresponding to the pre-revised pay scale from which the pensioner had retired. Therefore, denial of 50% f the pay  as basic pension is illegal and arbitrary.
  7. The Ernakulam Bench also pointed out the order of the Principal Bench of CAT Delhi that quashed the OM dated 03-10-2008 and 14-10-2008 and therefore the above two OMs are no more valid and no more in force. Therefore the decision of the CAT Delhi Principal Bench is also applicable to the applicants.
  8. The Bench also referred to the Principal Bench judgment and ruled that the benefit of 50% of minimum of pay in the pay band plus relevant Grade Pay shall be paid to the Petitioners even though they did not render 33 years of qualifying service.
The judicial verdict is another blow to the Government’s mis-interpretation on the following two counts:

  1. The minimum of Pay Band plus relevant GP instead of minimum of the pay in the Pay Band plus relevant Grade Pay of the Pre-2006 pensioners;
  2. 20 years Qualifying service instead of 33 years of qualifying service is applicable only for post-2006 retirees and not for Pre-2006 Pensioners.
In the background of this historic judgment all are requested to find out about such Pre-2006 pensioners who are denied full pension for not putting in 33 years service and make them represent for grant of full pension @ 50% of the minimum of pay in Pay Band plus Grade pay for the particular cadre in which they retired before 2006.

.......... in its Report Chapter-IX para-1.1 “It is therefore recommended that when ever it required to review the service conditions and wage structure of the employees of Department of Posts, ED Agents be bracketed along with departmental employees. There is no need to set up a separate Committee or Commission for the Extra Departmental Agents”


RECOMMENDATIONS OF THE FOURTH CENTRAL PAY COMMISSION CHAIRMAN JUSTICE (RETD) SHRI SINGHAL OF SUPREME COURT OF INDIA 

“‘the matter is beyond controversy after the decision of Supreme Court of India in Gokulanda Das’s case where it has been declared that ‘an Extra Departmental Agent is not a casual worker but holds a post under the administrative control of the State and that while such a post is outside the regular civil service, there is no doubt that it is a post under the ‘State’. In view of this pronouncement we are unable to accept the contention that “extra departmental employees are outside the purview of the terms of reference of our Commission”

STAND TAKEN BY DEPARTMENT OF POSTS IN DO LETTER No.17-13/2014-GDS dated 17-02-2014 ADDRESSED TO DEPARTMENT OF PERSONNEL & TRAINING – 

“The demand for inclusion in 7th CPC based on the definition of the expression ‘Central Govt. Employees adopted by 4th Central Pay Commission in para 1.11 of the report “as all persons in the Civil Services of the Central Government or holding Civil Posts under the Government and paid out of the consolidated fund of India” and its observations in para 1.17 & 1.18  - besides Apex Court’s judgement dated 22-04-1977 in the matter of Superintendent of Post Offices Vs. P.K.Rajamma regarding Gramin Dak Sevak services (earlier called Extra Departmental Agents) as holders of the civil post outside the regular civil service”….. 4th Central Pay Commission has categorically stated in para 1.10 that the expression ‘Central Govt Employees’ has not been defined in the Constitution or any other Law. It thus seems appropriate, if this term is duly defined based on which a final view over the inclusion of Gramin Dak Sevaks with in the purview of 7th CPC becomes possible”

Now it is learnt that the ‘ inclusion of GDS in the purview of 7th CPC’ rejected by MoF.

DoP Proposed to constitute a separate committee for GDS.

With this again we are going to face the dark age of another span of 10 years.

Curbs on Online Train Ticketing to Check Activities of Unscrupulous Elements Including Touts

Following curbs have been introduced by Indian Railways on online train ticketing to inter-alia keep a check on the activities of unscrupulous elements including touts: 

i. There is a restriction of only one booking in one user login session and forced logging out of the user before another booking while booking of tickets between 0800 and 1200 hours except for return/onward journey tickets. This is applicable to all users including IRCTC agents but excluding defence booking under warrants only. 

ii. Individuals are allowed only 2 tickets per user-id in a day (for Advance Reservation Period booking) from 0800 to 1000 hours. 

iii. Individuals are allowed only 2 tickets per use-id in a day (for Tatkal booking) from 1000 to 1200 hours. 

iv. Individuals are allowed only 2 Tatkal tickets per IP Address from 0800 to 1200 hours. 

v. Maximum number of tickets allowed to an individual is 10 per month. 

vi. Quick Book option is disabled from 0800 to 1200 hours. 

vii. Booking are not allowed through e-wallet and cash awards from 0800 to 1200 hours. 

viii. Agent booking is restricted from 0800 to 1200 hours except certain relaxations in the case of Rail Travellers Service Agents (RTSAs). 

ix. Provision of Captcha has been made in Registration, Login and Booking page to check fraudulent booking through automation software. 

x. In order to prevent alterations in the contents of Electronic Reservation Slip (ERS), the necessary technical changes to disable modification of pre-issued tickets have been implemented. 

This information was given by the Minister of State for Railways Shri Manoj Sinha in written reply to a question in Rajya Sabha today.
